Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the https://app.smartprobe.net.au website and SmartProbe platform (the “Service”) operated by SmartProbe-App (“us”, “we”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you do not have permission to access the Service.

Service description

The Service includes: (a) cloud software for temperature/telemetry monitoring, alerts, reporting, task and corrective-action workflows; and (b) associated hardware devices and sensors registered to your account.

Accounts & access

You are responsible for safeguarding login credentials and for all activity under your account. You must ensure only authorised personnel are granted access and that contact details for alerts are kept current.

Customer responsibilities

You are responsible for: (a) providing power/network connectivity for devices; (b) installing and maintaining probes in suitable locations; (c) configuring thresholds, sampling intervals, and notification recipients; and (d) keeping location/timezone settings accurate. We are not responsible for missed or delayed alerts caused by loss of power, connectivity, misconfiguration, or incorrect thresholds.

Subscriptions & billing

Paid features may be billed on a recurring basis (“Subscription”). Billing cycles are monthly or annual according to your plan. Unless stated otherwise, subscriptions renew automatically until cancelled via your account or by contacting SmartProbe-App support.

A valid payment method is required. By submitting payment details, you authorise us to charge applicable fees. If automatic billing fails, we may issue an invoice requiring manual payment by the due date.

Any promotional or trial offers apply only if explicitly provided; we may modify or withdraw such offers at our discretion.

Fee changes

We may change Subscription fees with reasonable prior notice. Continued use after the effective date constitutes acceptance of the new fees.

Data ownership, export, and retention

You retain ownership of telemetry, tasks, and other data you submit. You grant SmartProbe-App a license to store, process, and use that data to operate and improve the Service. Upon termination, we may delete or anonymise your data after a commercially reasonable retention period; request exports before or promptly after termination to avoid loss.

Service levels & maintenance

We aim for high availability but the Service may be unavailable during maintenance windows or outages. Alerts are provided on a best-effort basis and are not a guarantee of prevention of loss or spoilage. We may modify or discontinue features with notice where practicable.

Third-party services

We rely on third-party providers (e.g., hosting, email/SMS, analytics, payment processors) to deliver the Service. Those providers process data on our behalf under appropriate agreements. We are not responsible for third-party sites linked from the Service; review their terms and policies before use.

Termination

We may suspend or terminate access immediately for breach of these Terms or unlawful use. You may terminate at any time by discontinuing use and, if applicable, cancelling your Subscription. Data deletion may follow termination; request exports beforehand.

Limitation of liability

To the maximum extent permitted by law, SmartProbe-App and its directors, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses arising from your use of or inability to use the Service.

Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Changes

We may modify these Terms at any time. Material changes will be notified with at least 30 days’ notice where practicable. Continued use after changes take effect constitutes acceptance of the revised Terms.
